Assets & tasks / FIELD GUIDE
Can you publish every supplier photo used in an AI brief?
Possessing a supplier photograph does not establish every use you might make of it. Check the permission or agreement that actually covers the material and distinguish private reference, edited derivatives and public distribution. Obtain clarification when the scope is unclear.
Identify the exact asset and each proposed use
Record which supplier photograph is being discussed, who supplied it and what the actual agreement says. Keep private briefing, upload/AI processing, edited output, shop publication, paid advertising and public source/output demonstration as separate intended uses. A file in a chat does not document all of those uses.
The U.S. Copyright Office permission circular gives a US framework for investigating ownership and describing an intended use. It acknowledges limitations and cannot decide whether one applies to your situation. This worksheet is coordination, not a legal clearance result or a rule for every jurisdiction.
Keep unresolved uses unresolved
Fictional example, not an actual license: supplier photo SP14 has a recorded authorization for one named shop listing. The team now proposes an AI-edited advertisement and a public article showing the source beside the output.
| Use of SP14 | Recorded state in this invented case | Next step |
|---|---|---|
| Named shop listing | Documented within the stated scope | Preserve the exact scope and asset identity |
| Upload for AI processing | Not resolved by the recorded listing permission | Clarify before processing |
| Paid advertisement of edited output | Channel/derivative scope unresolved | Seek the appropriate rights decision |
| Public article showing SP14 | Supplier declines that publication use | Do not publish this source as the article example |
Do not read a listing authorization as an automatic answer about service processing or another channel. Ask the appropriate owner or adviser about unclear terms and exceptions. If the public example is not authorized, choose a separately cleared demonstration and label it accurately, rather than disguising it as the supplier’s case.
Link the permission record to the actual material
Identify the source file and each proposed output, not just a folder named “supplier assets.” Review visible third-party material such as a person, label or photographer credit separately. A supplier contact may not control every right in the frame. Cropping a watermark or changing the background does not itself establish permission.
Before upload, review the applicable service terms and actual permissions. Upload acceptance or a visually accurate output is not a rights decision. If an agreement changes, review the affected source, output and intended publications instead of assuming an old approval still covers them.
Keep the evidence private and the published scope accurate
Store the agreement or decision with appropriate access. The public asset package should not include contracts, personal correspondence, credentials or private filenames merely to prove that someone approved a use. Keep a minimal usable asset/allowed-use record for the publishing team.
Use private evidence versus public examples when selecting demonstrations and safe handoff for the transfer. No supplier, rights owner or adviser was contacted, and no actual agreement or customer file was reviewed for this article.
Sources and further reading
Recorded source-review dates are listed individually below. An undated source does not inherit the article’s publication date. Software and platform rules can change; check the current original before acting.

Frequently asked questions
Does a supplier sending the file authorize every use?
Check the actual scope for the exact material and intended uses. Possession does not document unrestricted permission.
What if AI processing or public demonstration is not addressed?
Keep the use unresolved until the appropriate owner or adviser clarifies it. Do not invent approval.
Does this register decide copyright exceptions or legal clearance?
No. The US reference is background; your material, agreement, jurisdiction and unresolved rights need appropriate review.
